Draft for owner review — effective at launch. These terms take effect when E:MERGENCE launches publicly. Until then they describe how we intend to run the service.
Terms of Service
The deal, in plain English.
These terms are an agreement between you and E:MERGENCE LLC. They cover our websites, your E:MERGENCE account, and our apps: E:Voice, AERIS Node, AERIS OS, Charles and Roofer Buddy. By creating an account or using the apps, you agree to them.
The short version
- The mobile apps have a Free plan. The paid plan is $19.99 a month and covers every app, including AERIS OS.
- Cancel any time in the store you paid through. You keep access until the end of the period you paid for.
- Refunds follow the rules of the store you paid through: Google Play or Stripe.
- AI can be wrong. Check anything important before you rely on it.
- AI services you connect yourself are your own accounts, with their own terms and charges.
- Your content is yours. Don't use the service to hurt people or break the law.
1. Your account
- You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
- Give accurate sign-up details and keep your password to yourself. An account is for one person. You are responsible for what happens under your account, including what agents you authorise do with it.
- Tell us straight away at evoice@emergencerising.com if you think someone else has got into your account.
- You can delete your account at any time from E:Voice (Settings → Account) or on the account deletion page. The Privacy Policy explains what deletion removes.
2. Plans and prices
Free
$0. No card, no time limit.
Our mobile apps, including E:Voice with its native crew, on-device voices and local AERIS Node memory.
Paid
$19.99 a month.
All E:MERGENCE apps, including AERIS OS on your desktop, with the paid features and monthly managed-voice allowances shown in your account.
Prices are in US dollars. Tax is added where the law requires it, and a store may show the price in your local currency. What each plan includes can change as the products grow. If we reduce what a paid plan includes, or raise its price, we will tell you before your next renewal, and you can cancel before it applies.
Managed allowances (for example, premium voice time) are part of the service. They are not money: they have no cash value, cannot be transferred and are not credit with any third party. Unused allowance does not carry over except where your plan says it does.
Some features are labelled preview, beta or "coming soon". They may change, stop or fail more often than finished features. Please don't rely on them for anything critical.
3. Billing and renewal
You pay through one of two stores, and that store handles the payment:
- Google Play, when you subscribe inside the Android app. Google Play's terms also apply.
- Stripe, when you subscribe on our website.
Subscriptions renew automatically each month and are charged to your payment method until you cancel. If a payment fails, paid features may pause until it succeeds. You keep your Free access and your data.
4. Cancelling
You can cancel whenever you like, and there is no cancellation fee. Cancel where you subscribed:
- Google Play: in the Play Store app, go to Profile → Payments & subscriptions → Subscriptions.
- Web (Stripe): in your E:MERGENCE account, or email us and we will do it for you.
After you cancel, your paid features continue until the end of the period you already paid for. After that, the account moves to Free. Uninstalling an app does not cancel a subscription.
5. Refunds
Refunds follow the store you paid through:
- Google Play purchases are refunded under Google Play's refund policy. You request them through Google Play. We can also issue a refund for a Play purchase in cases Google allows.
- Stripe (web) purchases: email evoice@emergencerising.com with the account email and what went wrong. We will look at every request fairly.
Nothing in these terms takes away a refund or cancellation right that the law where you live gives you.
6. Acceptable use
Use E:MERGENCE for real work and honest fun. Don't use it to:
- break the law, or help someone else break it;
- harass, threaten, exploit or impersonate people, or post other people's private information;
- create or share sexual content involving minors, or content that promotes violence against people;
- send spam or malware, or attack, probe or overload our systems or anyone else's;
- get around sign-in, plan limits, allowances, rate limits or other safety measures, or resell or share access to the service;
- scrape the service, or copy it to build a competing product, except as the law allows;
- point agents at computers, accounts or data you have no right to control.
Community spaces on emergencelanding.com (the Bulletin, E:Builders Feeds and profiles) are public. We may remove posts that break these rules.
7. Your content
You own what you create and upload: your messages, documents, projects, memory, voices, images and posts. You give us permission to host, process and transmit it only as far as we need to run the features you use. For public posts, you also let us show them publicly. That permission ends when you delete the content or your account, apart from copies other people have already shared or that we must keep by law. Make sure you have the right to anything you upload.
If you send us feedback or ideas, we may use them without owing you anything.
8. AI output
E:Voice, Charles, Frank and the agents you connect produce answers with AI models, and those answers can be wrong, incomplete, out of date or unexpected. They are not professional advice (legal, medical, financial, safety or otherwise). Check anything important before you rely on it.
Agents you connect to your own computer can run commands, change files and act on accounts with the permissions you give them. You decide what to allow, and you are responsible for what you ask them to do. Keep backups of anything that matters.
Please don't use voice features in a way that takes your attention from driving or other work that needs it. Follow the law where you are.
9. Services you connect
E:Voice and AERIS OS can connect to AI providers and runtimes such as Claude Code, Codex, Cursor, Hermes, OpenClaw, Agent Zero, Grok, OpenAI, Anthropic, Google Gemini, OpenRouter or your own endpoint. When you pair or add one of these, you are using your own account with that company. Their terms, privacy policy, limits and charges apply between you and them. We don't control those services and aren't responsible for what they do, what they cost, or whether they are available. Keys you store in the app remain yours.
10. Our software
While you follow these terms, we give you a personal, non-exclusive, non-transferable licence to use our apps and services. The apps, websites, the E:MERGENCE, E:Voice, AERIS and Frank names, and our characters and artwork belong to E:MERGENCE LLC. Apps may update themselves or ask you to update, so that they stay secure and compatible.
11. Suspension and ending
You can stop using the service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk, or where the law requires it. Where it is safe and lawful to do so, we will tell you why and give you a chance to respond. If we ever shut down a paid service entirely, we will give reasonable notice and refund any unused prepaid period.
12. Warranties and liability
We work hard to make the service reliable, but we provide it "as is" and "as available". To the extent the law allows, we make no warranties beyond those in these terms: no warranty of merchantability, fitness for a particular purpose or non-infringement, and no promise of uninterrupted or error-free service.
To the extent the law allows, E:MERGENCE LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Some places don't allow these limits, and then they apply only as far as the law permits. Nothing here limits liability that the law does not allow to be limited.
13. Disputes and governing law
If something goes wrong, email us first. Most problems can be fixed quickly that way. These terms are governed by the laws of the US state in which E:MERGENCE LLC is organised and by applicable US federal law, without regard to conflict-of-laws rules. If you are a consumer, you keep the protection of the mandatory laws of the place you live, and you may bring a claim in your local courts where that law allows.
14. Changes and contact
When we update these terms, we will change the date at the top. If a change is significant, we will tell account holders by email or in the app before it takes effect. If you keep using the service after that, you accept the new terms. If you don't agree, you can cancel and delete your account.
If one part of these terms can't be enforced, the rest still applies. These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
